Rates

Under Section 181(14) of the Local Government Act 1999, Councils must provide the opportunity for all ratepayers to pay rates by quarterly instalments.

The Local Government Act 1999 provides that Councils impose an initial 2% fine- penalty on quarterly payments that are received late. All arrears / overdue rates that remain outstanding at the end of each monthly cycle are charged an interest rate, according to the Cash Advance Debenture Rate (CADR) issued from the Local Government Finance Authority (LGFA), as at 1st July each year.

Council issues a reminder notice for payment of overdue rates during the months of September, December, March and June of each year. Should rates remain unpaid more than 14 days after the issue of the reminder notice then Council will review the debt for debt recovery action as per Council's Debt or Management Policy. If the account is referred to Council's debt collection agency (Credit Clear) collection fees and court costs are recoverable from the ratepayer. All costs incurred by Council in the recovery of outstanding rates and fines are payable by the ratepayer.

When Council receives a payment in respect of overdue rates, Council applies the money received as follows:

  1. Payment of any costs awarded to, or recoverable by, the Council in any court proceedings undertaken by the Council for the recovery of the rates;
  2. Satisfaction for any liability for interest;
  3. Payment of any fine;
  4. Satisfaction of liabilities for rates in the order in which those liabilities arose in payment of rates, in date order of their imposition (starting with the oldest account first).

Any ratepayer who may be, or is likely to, experience difficulty with meeting the standard payment arrangements should refer to Council's Rate Hardship Policy (excluding Water Policy Requirements) and is invited to contact Council's Revenue Recovery Officer, on 08 8525 3200 to discuss alternative payment arrangements. All enquiries are treated as confidential by the Council.

Postponement of Rates - Seniors

Ratepayers who hold a State Seniors card (or who are eligible to hold a State Seniors card and have applied for one) are able to apply to Council to postpone a payment of rates on their principal place of residence. Postponed rates remain as a charge on the land are not required to be repaid until the property is sold or disposed of. Interest will accrue on the amount of rates postponed at the prescribed rate per month (applied with respect to the amount postponed and compounded on a monthly basis) until the amount is paid. Should you be eligible for a State Government funded concession this will be paid directly to you by the Department of Human Services and is not provided via your rates notice.
