Delegations Register
Councils have certain duties which they must perform, and certain powers which they may exercise, pursuant to the Local Government Act 1999 as well as a range of other Acts. In most cases the relevant Acts confer those obligations and powers directly on the Council as a body.
It is not practical or efficient for the Council as a body of elected members to perform the many functions or undertake the many activities that are required in the day to day administration of the Council's roles and functions. Delegations are the way in which the Council enables other people/bodies (usually Council officers) to undertake these steps on its behalf.
Elected Member Register of Interest
In order to be as transparent as possible to Council’s community in the decision making process, Elected Members are required to lodge with the Council a Primary Return at the commencement of their term in office and then annually via an Ordinary Return, disclosing their interests.
In accordance with Section 68 and Section 70 of the Local Government Act 1999 the Chief Executive Officer is required to maintain and publish a Register of Interests of Members of Council.
Elected Members Training and Development Register
Elected Members are required in the first 12 months of office to complete mandatory training requirements in accordance with Section 80A of the Local Government Act 1999 and Regulation 8AA of the Local Government (General) Regulations 2013.
Under the Local Government Act 1999 section 80A (2h) the Chief Executive Officer must maintain a register relating to training and development in accordance with the regulations.
Gifts and Benefits Register
Elected Members
The Code of Conduct for Council Members commenced on 1 September 2013 through the Local Government (General) Variation Regulations 2013, gazetted in the Government Gazette on 22 August 2013. It requires that gifts and benefits received by Council Members be recorded on a register, which is available to be viewed by the public. For the purposes of 3.10 of the Code of Conduct, the threshold amount governing when a gift or benefit must be registered is gazetted at $50.
Council Employees
The Code of Conduct for Council Employees commenced on 13 February 2014, published by the Minister for Planning for the purposes of Section 110(1) of the Local Government Act 1999, gazetted in the Government Gazette on 13 February 2014 and re-gazetted on 20 February 2014. It requires that gifts and benefits received by Council Employees be recorded on a register, which is available to be viewed by the public. For the purposes of Clause 2.21 of the Code of Conduct, the threshold amount governing when a gift or benefit must be registered is currently gazetted at $50.
