Local Nuisances and Illegal Littering
What is a nuisance?
The Local Nuisance and Litter Control Act 2016 outlines what defines a nuisance and what Council has the powers to address. In order to breach the law, the particular nuisance must spread to your property and be considered unreasonable. Concerns regarding loud music or motor vehicle noise are dealt with by the Police. For these matters call 08 8566 2266.
Before lodging a complaint with Council
Council takes nuisances very seriously. To effectively evaluate your concern and if warranted to take any enforcement action, sufficient evidentiary information must be provided. This includes the completion of a Nuisance Activity Diary. Each matter is looked at on its merits and can involve a visit to your property to verify the complaint and determine if the nuisance reported is reasonable or unreasonable as per the law.
To make a formal complaint, upload your Nuisance Activity Diary to Contact Us.
Illegal Dumping (Littering)
Littering is a continuous problem and Council seeks the publics assistance to report any littering so that council can take action.
If littering is observed by a member of the public and the name and address of the offender is known or if a registration number can be obtained from a vehicle associated with littering such as a person dumping items taken from their boot of their car, then council can follow up on this. Any supporting photos are of assistance. A person reporting littering under these circumstances needs to be prepared to give a statement and attend court if needed.
